If you provide us with Data, we will understand that you agree with the terms of this Policy, the purposes of the processing of your Data, as well as the means and procedure that we make available to you to exercise your rights of access, rectification, cancellation, and objection in section VI of this Privacy Policy.
In accordance with the provisions of the General Law on the Protection of Personal Data Held by Obligated Parties and its Regulations, we hereby bring this Privacy Policy to your attention, under the following information:

In the event that we enter into with you an act related to any service offered by us, your Data will be used for the fulfillment of the obligations arising from that legal relationship. In the event that no act is finalized with you, the Data you have provided to us will be blocked and subsequently deleted.
The information that has been blocked may be retained for the period necessary to comply with legal provisions such as those of a tax or commercial nature, and will subsequently be deleted.
III. DATA COLLECTED
We collect your personal data directly when you request one of the services indicated in point II regarding the PURPOSES, when you provide them to us through various means. The data we obtain by this means may include, among others:
The processing of this personal data requires, in accordance with articles 12 and 13 of the General Law on the Protection of Personal Data Held by Obligated Parties, and article 15 of its Regulations, the express written consent of its owner, since it involves sensitive data and data of an asset-related nature; therefore, I accept that LA EMPRESA SICAR S.A. DE C.V. carry out the processing of the referenced data, based on the purposes set out in section II of this Privacy Policy.
This Data is essential for the provision of our services and, where applicable, billing, and will be processed solely for the purposes established in this Policy.
IV. DATA TRANSFERS
Pursuant to articles 59 and 60 of the General Law on the Protection of Personal Data Held by Obligated Parties, the Data may be lawfully transferred, for the Purposes established in this Privacy Policy, to holding, subsidiary, or affiliated companies under the common control of the controller, or to a parent company or any company of the same group as the controller that operates under the same internal processes and policies, such as SICAR S.A. DE C.V., RANCHO TEPAMES S.P.R. de R.L., HEALTHY AND FRESH FRUIT S.A. DE C.V., INTERNATIONAL TRADING FRESH SA DE CV, Y LIMEX FRESH S.A. DE C.V., LIMEX SICAR, LTD. CO, AUTOTRANSPORTE SICAR S.A. DE C.V., SIGIFREDO GUDIÑO TOSCANO, and DESHIDRATADORA TECOMENSE S.A. DE C.V., which recognize among themselves economic and decision-making autonomy, but unity in their commercial ties.
Where applicable, from this moment and with regard to points 1, 2, 4, and 5, “the Data Owner” accepts that “the Controller” carry out the transfer of personal data when it is necessary due to the activities performed, such as in the case of the subcontracting of services or where the provision of the contracted service is carried out by fully identified third parties who are bound to maintain confidentiality with respect to all the information in its possession and to which they may have access for any reason.
Apart from the foregoing, the CONTROLLER does not carry out transfers of the Data without having previously obtained your consent, when such consent is required in accordance with the Personal Data Law. In the event that there is a need to carry out a transfer to third parties in order to fulfill the Purposes (other than those indicated in the preceding paragraphs), for which the Personal Data Law requires your consent, the CONTROLLER will bring this to your attention. In the event that you do not object, it will be understood that you have granted your consent to carry out the transfer.
The CONTROLLER will communicate to the third parties to whom, where applicable, it transfers the Data, this Privacy Policy and the purposes to which you subjected its processing. Where applicable, the processing of the Data by the third party must be carried out in accordance with what is agreed in this Privacy Policy, and the third party must assume the same obligations that correspond to the CONTROLLER.
V. DATA PROTECTION
We hereby inform you that your personal data will be safeguarded under strict administrative, technical, and physical security measures, stating that all persons in charge of the processing of Personal Data at the CONTROLLER have signed an agreement by which they are bound to maintain confidentiality with respect to all the information in its possession and to which they may have access for any reason. The databases containing Personal Data are safeguarded within the company SICAR S.A. DE C.V. or the CONTROLLER companies.
VI. ARCO RIGHTS

Said request must contain at least: (a) your full name; (b) an indication of whether the request is submitted personally or through your representative; (c) your address; (d) your telephone number; (e) an indication of whether you agree that the notifications we make in relation to your request take effect through the email you provide us; (f) a clear and precise description of the Personal Data with respect to which you request to exercise any of the ARCO rights, in addition to what is indicated in this section, the modifications to be made, and the provision of documentation supporting your request; (g) where applicable, your express statement to revoke consent to the processing of your Data; (h) any other element that facilitates the location of your Data (date on which the Data was provided to us, identification number of the act carried out, person who assisted you, areas involved); and (i) the documents that prove your identity and/or legal capacity with a notarial power of attorney.
Please remember that, in accordance with article 37 of the Law, in order to process your request you must first prove your identity or legal capacity to us through personal attendance, presenting the original and a copy of your official identification and/or notarial power of attorney.
When Access and Rectification requests are submitted and if you reside outside the City of Tecomán, Colima, you may submit the request electronically by attaching a scanned copy of your official identification and/or notarial power of attorney and await our response with instructions on how to proceed, within a maximum period of 20 business days. Likewise, the owner guarantees that the Data provided is truthful, accurate, and complete, and is therefore liable for any damages resulting from falsehood or identity theft. In the case of rectification requests, you must accompany the documents that support the request and the specific Data you wish to modify. Said documents must be presented in original and copy for verification. The remainder of the procedure will be processed in accordance with the periods and stages established in the Law.

VII. PRIVACY OF MINORS
We do not provide services to minors nor do we approve service requests originating from them. Consequently, we do not establish or maintain records of Data of any minor of whom we are aware. However, if we discover that we have received Data or personal information from a person who indicates that he or she is a minor, or from any other person whom we have reason to believe is a minor, we will cancel said Data in accordance with the terms established by the Law.
In the event that a minor fraudulently presents himself or herself as being of legal age, he or she will be subject to the corresponding responsibilities of any nature. We ask parents to supervise their children while they are online or when they make telephone calls.
VIII. CONSENT
Where applicable, if you do not express your objection to your Data being processed under the terms indicated in this Policy, it will be understood that you have granted your consent for this.
IX. COOKIES AND WEB BEACONS
We inform you that on our website we do not use cookies or web beacons to obtain personal information and, in the event of carrying out the transfer of data within the controller companies, as has been indicated in this Policy, the same processing indicated herein will be applied.
X. COMPLAINTS AND REPORTS

XI. UPDATES TO THE POLICY
Our company reserves the right to modify or supplement this Privacy Policy at any time. In the event of any modification to this Policy, it will be brought to your attention on our Website or you may consult it at our address. We will not be liable in the event that you do not receive the aforementioned notification of a change to the Privacy Policy due to any problem with your email account or with the transmission of data over the internet.
